This Online Privacy Policy (the "Privacy Policy") sets forth certain terms and conditions according to which Le Festa ("Le Festa") as a“Controller” within the meaning of the General Data Protection  Regulation (EU Regulation 2016/679), may collect, store and use certain information and data concerning or provided by anyone visiting the Le Festa Platform, and/or registering as Guest or as a Host. It also explains the conditions under which Le Festa uses and discloses that information, and the User rights in relation to that information. 

This Privacy Policy applies to all personal data collected by Le Festa online through the Le Festa Platform. This Privacy Policy does not apply to information or data that may be collected by Le Festa offline.

This Privacy Policy is incorporated into and is a part of Le Festa’s Terms & Conditions. The definitions used and described in article 2 of said Y&C apply to this Privacy Policy.

     1.    What information may Le Festa collect and when and for what purposes?

Le Festa may collect and process personal data that a User provides by visiting the Le Festa Platform, creating an account, filling in forms on the Le Festa Platform, posting material, editing User’s profile, purchasing Products or requesting further services or information. Below, Users can read more about the exact data that Le Festa collects, the purposes and the legal base of that collection, and with which third parties the User’s data is shared. 

     A.    Data Le Festa collects from Users 
In the event that a User is visiting the Le Festa Platform without creating an account, Le Festa collects the following personal data.

What data:

     •    IP address;
     •    Traffic data (information about a User’s online behaviour);
     •    Location data;
     •    In the event that a User reaches out and requests further services of information of Le Festa,also a record of the correspondence and other communication data.


For what purposes: 

Le Festa collects this data to improve its online services, products and User’s browsing experience, and, in case a User has reached out, in order to help User with further requests or complaints.

     B.    Data Le Festa collects from Hosts

In the event that a User creates a Host account, Le Fest collects the following personal data.

What data:

     •    Name of the host;
     •    Name of the restaurant /Name of entity represented, if applicable;
     •    Address of restaurant/host and address of  entity representing the restaurant;
     •    IP address;
     •    Date of Birth of representative (for Business accounts) or host;
     •    Bank Account details (account number) of the host or restaurant.


For what purposes: 
Le Festa uses the data Hosts save in their Host account to process Hosts events and to execute the agreement Le Festa has with the Host.

On which legal basis: 
When registering on our Le Festa Platform by opening a Host account, Hosts are requested to explicitly opt-in and approve the collection of their data. Notwithstanding this approval, the processing of the data is necessary for the execution of the Products and to complete the agreement Le Festa has with the Host. 

     C.    Data Le Festa collects from Guests

What data:

     •    Name;
     •    Address;
     •    IP address;
     •    Date of Birth;
     •    Email;
     •    Telephone;
     •    Food preference and information about food restrictions if any ( but this is  not mandatory).

For what purposes: 

Le Festa uses the data Guests save in their Guest account to process Products that Guests purchase through the Le Festa Platform and, therefore, to execute the agreement Le Festa has with such Guest.

On which legal base: 

When registering on our Le Festa Platform by opening a Guest account, Guests are requested to explicitly opt-in and approve the collection of their data. Notwithstanding this approval, the processing of the data is necessary for the execution of the Products and to complete the agreement Le Festa has with the Guest. 


     2.    With whom does Le Festa share the information?

Le Festa does not sell, trade, or otherwise transfer to outside parties any User personal data, except for the following.
Le Festa may disclose User’s personal data to other third parties:

  • If and insofar as a User has given Le Festa explicit written consent for such disclosure; 
  • If Le Festa is under a duty to disclose or share User’s personal data in order to comply with any legal obligation, or in order to enforce or apply the T&C’s and other agreements, of which the User whose data is disclosed shall be notified in advance;
  • If it serves a vital business interest of Le Festa, in order to operate the Le Festa Website or its Services, Le Festa may exchange personal data with other companies and organisations for example for the purposes of fraud protection, credit risk reduction and execute the agreements with Hosts and/Guests. Such other companies and organisations shall qualify as “Processors” under the General Data Protection Regulation.

Non-personally identifiable User information may be provided to other parties for marketing, advertising, or other uses. Le Festa does not disclose any of User’s personal data advertisers without User’s explicit and prior written consent. 


     3.    How does Le Festa safeguard the data that it collects?

The safety of User’s personal information is paramount to Le Festa and Le Festa uses a variety of common security methods in accordance with current data protection standards, to maintain the safety of User’s information when User creates an account, purchases Products, submits, or accesses User’s personal data.

Le Festa offers the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into Le Festa’s payment gateway providers (Stripe) database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.


     4.    How long will User’s data be saved?

Le Festa does not save User’s data longer than legally permitted and is necessary for the purposes for which User’s data is processed. The length of time certain data is saved, depends on the nature of the data and the purposes for which they are processed.


     5.    Correction of User’s data and other rights Users have 

     A.    Insertion, correction and removal of User’s data

On User’s request, Le Festa shall provide User with an overview of User’s personal data known to Le Festa. All Users of the Le Festa Platform may review, update, correct or delete the personal data by doing so in their registration profile on the Le Festa Platform or by contacting Le Festa at unsubscribe@leLe Festa.com and shall receive a confirmation that the email was received. Le Festa shall remove or modify User’s data within 4 weeks after the confirmation has been sent. 

If User would like Le Festa to cancel User’s Le Festa Host or Guest Account, Le Festa shall attempt to accommodate such request insofar as no legal obligation or a legitimate business reason to retain the information contained in User’s Le Festa Account keeps Le Festa from deletion. 

     B.    Making objections

If a User disagrees with a specific processing of User’s data, a User can object by sending an email to info@lefesta.com  at any time. After receiving User’s email, Le Festa shall respond to User’s appeal as soon as possible, but at least within 4 weeks.

     C.    Data Portability

The right to data portability means that any User has the right to receive all personal data that Le Festa processed of this User in a structured, current and machine-readable form and transfer it to another controller. 
A data-portability request can be made by sending an email to info@lefesta.com  Upon receipt of User’s request, Le Festa shall inform User about the forms in which Le Festa can deliver the transferable data. The personal data requested by User shall be delivered in the requested form within one month, or within a maximum of three months in complex cases after having received the request from the User.

     D.    Withdrawal of previously granted permission

Any User that has given Le Festa permission to process User’s personal data, may withdraw this permission at any time by sending an email to info@lefesta.com   Le Festa shall reply and confirm such request for withdrawal of consent as soon as possible, but in any case within 4 weeks after having received it.


     6.    Our privacy policy regarding children 

Le Festa does not permit access to the Le Festa Platform by children under the age of 13. Users under the age of 13 years, User should not access, or attempt to obtain access to the Le Festa Platforms. Once a child states that his/her age is under 13, Le Festa does not collect or store any personally identifiable data such as name, address or email address.


     7.    Third party links

Le Festa may, at its own discretion, include or offer third party products and services or third party links on The Le Festa Platform. These third party websites have separate and independent privacy policies. Le Festa therefore has no responsibility or liability for the content and activities of these linked Le Festa Platforms. Nonetheless, Le Festa seeks to protect the integrity of the Le Festa Platform and welcomes any feedback about such websites.


     8.    User’s Consent  

By using Le Festa Platform, creating an account, placing or purchasing a Product, creating and posting User Content, User warrants and guarantees to have read, understood and approved this online privacy policy.

This privacy policy may change from time to time, check back regularly to stay informed of any changes. Le Festa will notify User by email (sent to the e-mail address specified in User’s Le Festa Account) or by means of a notice on the Le Festa Platform and Application prior to the change becoming effective. User’s continued use of the Le Festa Platform or the Services, or accessing User’s account, following such changes, constitutes and signifies User’s full acceptance of such changes.


     10.    Cookies and other technologies used by Le Festa

     A.    Why does Le Festa use cookies and what type of cookies does Le Festa use?

Le Festa may use cookies and other technologies to collect analytic data, such as demographic information, personalize User’s experience on the Le Festa Platform and monitor advertisements and other activities. Cookies are small files downloaded to User’s computer to track movements and behaviour within web Le Festa Platforms. 

The Le Festa Platform may use cookies to:

  • Keep track of User’s shopping habit and make sure Users do not see the same ad repeatedly;
  • Deliver content specific to User’s interests and for other purposes;
  • Collect information on the frequency that certain promotions or digital activities are accessed, how much time is spent engaging certain informational content, and which ads or links are clicked;
  • Link cookie information to personal information. 

Le Festa also maintains log files which contain Internet Protocol ("IP") addresses. In general, Le Festa only uses log files to monitor traffic on the web Le Festa Platform, to report aggregate information to advertisers and third party service providers and to troubleshoot technical problems. In the event of User abuse of the Le Festa Platform; however, we may block certain IP addresses or console IDs provided by  licensed hardware manufacturers. IP addresses and console IDs may be used to personally identify Users in order to enforce Le Festa’s T&Cs. 

Other technologies used in the Le Festa Platform include clear GIFs and IP address logging. Clear GIFs (a.k.a. web bugs, beacons or tags) are small graphic images placed on a web page, web-based document, or in an e-mail message. Clear GIFs are invisible to the User because they are typically very small (only 1-by-1 pixel) and the same color as the background of the web page, document or e-mail message. Le Festa does not use clear GIFs to collect personal data about any User. However, Le Festa may use clear GIFs to capture statistical usage information for the Le Festa Platform, web pages, features or other elements on a web page. Le Festa may correlate this information to a user to personalize User experience and for statistical analysis of User experiences on the Le Festa Platform.

An outside ad company may assist Le Festa on its Platform to display ads provided by third-party networks. These ads may contain cookies. Cookies received with banner ads are collected by ad companies, and Le Festa does not have access to this information. 

     B.    Manage User’s cookies

A User can disable cookies or set a User’s browser to alert User when cookies are being sent. By using browser settings on User’s computer; User can delete already deleted cookies and refuse to post new cookies.

Note: If User refuse and / or delete cookies, User may not always be able to use all of the features of the Le Festa Platform. Additionally, refusing or removing cookies only affects the computer and browser on which User perform this operation. If User use multiple computers and / or browsers, the User has to repeat the above action (s) as often as necessary.
